DISTANCE SALES CONTRACT
Article 1 - Parties
1.1 Seller

1.2 Buyer
The Buyer refers to the individual who completes and submits the order form electronically on the www.esracanikligil.com shopping site or the person specified during the order process.
If no other explanation is provided, the person filling out the order form will be considered the Buyer under this Agreement.
Article 2 - Date of the Agreement
The agreement between the parties is established when the Buyer confirms their order on the website (www.esracanikligil.com). Once the order is confirmed, a copy of this Agreement is sent to the Buyer’s email address.
By completing the order, the Buyer acknowledges that they are obligated to pay the total order amount, including any additional costs (such as shipping fees, taxes, etc.), and that they have been informed of these obligations.
The domestic shipping fee is covered by the Seller, while for international sales, the Buyer is responsible for shipping costs, customs duties, and other external charges.
Article 3 - Scope of the Agreement
This Agreement defines the rights and obligations of both parties concerning the sale and delivery of products purchased by the Buyer through the website www.esracanikligil.com, owned by Esra Canikligil Design Ltd. Şti. The Agreement is governed by the Consumer Protection Law, Turkish Commercial Code, Turkish Code of Obligations, and Regulations on Distance Contracts.
The preliminary information is available on http://www.esracanikligil.com. The pre-information and the invoice issued based on the Buyer’s order form are integral parts of this Agreement.
Prices displayed on the website are sales prices and remain valid until updated. Prices announced for a limited time will be valid until the specified period expires.
Article 4 - Delivery of Goods and Terms of Delivery
Each EC Jewellery product is handcrafted in our Istanbul workshop and made to order.
We always strive to fulfill orders as quickly as possible.
• If the product is in stock, it will be shipped within 1-5 business days.
• If the product is out of stock, the production time is 7-10 business days.
• Custom-designed and made-to-order products may have varying delivery times.
4.1 Delivery Process
The product(s) ordered will be packaged securely and delivered with the invoice to the address specified by the Buyer via the Seller’s contracted shipping service. Purchased products will be delivered within 30 days from the confirmation of the order and establishment of the contract. If necessary, this period may be extended by 10 additional days. If the product cannot be delivered within this timeframe, the Buyer has the right to terminate the Agreement.
4.2 Delivery to a Third Party
If the product is to be delivered to someone other than the Buyer and the recipient refuses delivery, the Seller is not responsible.
4.3 Damaged Shipments
If there is any damage caused by the shipping company, the Buyer must refuse the package and ask the shipping company to file a report. Otherwise, the Seller will not be responsible for any issues.
4.4 Shipping Fees
• Domestic orders: The Seller covers the shipping fee.
• International orders: The Buyer is responsible for shipping fees, customs duties, and other related costs.
4.5 Payment Issues
If payment for the product is not received or if it is canceled in banking records, the Seller is not obligated to deliver the product.
Once the product is delivered, responsibility for usage and any damages passes to the Buyer.
Article 5 - General Terms
• The key features, price, payment method, and delivery fees of the products are provided on the Seller’s website. The Buyer acknowledges having reviewed this information and confirmed it electronically.
• By confirming the Pre-Information Form, the Buyer agrees that they have received accurate details regarding the order, including the address, product features, total price (including taxes), payment, and delivery information.
• The Seller guarantees the delivery of the product undamaged, complete, and in accordance with the order specifications, along with any applicable warranty documents and user manuals.
• Before the delivery deadline, the Seller may provide an alternative product of equal quality and price, provided the Buyer is informed and consents.
• If the ordered product becomes unavailable, the Seller must inform the Buyer before the deadline and may offer a substitute product.
• If the Seller is unable to deliver due to force majeure, they must inform the Buyer as soon as possible.
Article 6 - Right of Withdrawal
• The Buyer may withdraw from the contract within 14 days of receiving the product without providing any reason or incurring penalties. This request must be submitted in writing via registered mail, fax, or email.
• To process a return, the original invoice, return form, and shipping receipt must be provided. Upon receipt, the refund will be issued within 10 days.
• The Buyer is responsible for the return shipping costs.
• The product must not be used, damaged, or altered, and it must be returned with all original packaging and accessories.
• Customized products, such as rings made to the Buyer’s size, are non-refundable and cannot be exchanged.
Article 7 - Non-Returnable Products
The Buyer cannot use the right of withdrawal for the following:
• Products subject to price fluctuations beyond the Seller’s control.
• Items custom-made to the Buyer’s specifications.
• Perishable or expired products.
• Items that have been opened and are not suitable for return due to health/hygiene reasons (e.g., earrings).
• Digital content and non-tangible goods once delivered.
Article 8 - Jurisdiction
In case of disputes, the Buyer may file complaints with Consumer Arbitration Committees or Consumer Courts in the Buyer’s or Seller’s jurisdiction. The monetary limits for disputes are determined annually by the Ministry of Industry and Trade.
Article 9 - Privacy and Data Protection
Both parties agree to keep confidential any business-related information obtained during the contract period. Neither party may use this information for personal gain or share it with third parties.
The parties must comply with the Law on Protection of Personal Data (Law No. 6698) and related legislation. The Seller must take all necessary technical and administrative precautions to ensure data security.
If unauthorized access to personal data occurs, the responsible party must notify the Buyer immediately and take appropriate measures.
